Terms of Service

1. Acceptance of Terms

By creating an account on ReSwaps ("Platform"), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Platform. We reserve the right to update these terms at any time — continued use of the Platform constitutes acceptance of the revised terms.

2. Eligibility

You must be at least 18 years old and a resident of Malaysia to use ReSwaps. By using the Platform, you represent and warrant that you meet these requirements.

3. The Swap Process

3.1 Listings. All items listed must be accurately and honestly described. You must disclose all known defects at the time of listing — including scratches, dents, cracks, stains, missing parts, or any functional issues. Declared value must reflect the item's fair market value.

3.2 Minimum Value & Weight. Items must have a declared value of at least RM50 and must not exceed 5kg. Items outside these limits may be rejected at the warehouse.

3.3 Swap Matching. Swap offers are only valid between items within approximately 80%–120% of each other's declared value.

3.4 Binding Agreement. Once a swap offer is accepted by both parties, it is binding. Cancellation after acceptance may result in penalties as described in Section 6.

4. Warehouse Process

ReSwaps operates a physical warehouse middleman model. All swaps are routed through the ReSwaps warehouse:

  1. Ship to Warehouse. Both parties ship their items to the ReSwaps warehouse using the provided prepaid inbound shipping label.
  2. Inspection. Our team inspects and photographs each item against its listing description and declared defects.
  3. Dispatch. Once both items pass inspection, we repack and dispatch them to the respective recipients using outbound shipping labels.
  4. Confirmation. Each party confirms receipt via the Platform. Once both confirm, the swap is marked complete.

The warehouse inspection record — including photographs taken at the time of receipt — serves as the official reference for any subsequent dispute.

5. Fees & Credits

5.1 Shipping Fee. Shipping fees are calculated dynamically based on item weight and courier selection. The amount is deducted immediately upon swap acceptance and is non-refundable once shipping labels are issued, except where the other party fails to ship (see Section 6).

5.2 Platform & Inspection Fee. A fee of 7% of your item's declared value is deducted upon swap completion. This covers physical inspection of your item at our warehouse, condition verification against your listing, secure repackaging in ReSwaps-branded packaging, and outbound dispatch handling.

5.3 Parcel Insurance. Items with a declared value of RM400 and above are subject to a mandatory parcel insurance premium of 5% of the declared value, covering both the inbound and outbound shipment legs via our courier partner. For items valued between RM200–RM399, insurance is optional and must be selected by the proposing party. Items below RM200 are not eligible for insurance. Insurance premiums are deducted upon swap completion.

5.4 Welcome Credit. New users receive RM10 in platform credits upon registration.

5.5 Top-Up. Minimum top-up is RM20 via FPX or card.

5.6 Nature of Credits. Credits are non-refundable, non-transferable, and cannot be cashed out. Credits expire if your account is terminated for cause.

6. Cancellation Policy

Stage 1 — Before either party ships. Either party may request a cancellation. The other party must agree. If agreed, the swap is cancelled with no penalty and both parties retain their credits (shipping fee not yet charged).

Stage 2 — One party has shipped, the other has not. The party who has already shipped cannot cancel freely. The non-shipping party will be penalised: their shipping fee is forfeited and a 2% penalty is charged. The party who shipped will have their shipping fee refunded.

Stage 3 — Both parties have shipped. Cancellation is not permitted. If there is a legitimate issue, the dispute process applies (see Section 7).

7. Disputes & Warehouse Protection

7.1 Dispute Window. Disputes must be raised within 72 hours of warehouse dispatch. Once this window closes, the swap is fully settled and no claims will be entertained.

7.2 Dispute Grounds. The following are valid grounds for a dispute:

  • Item is broken, cracked, or structurally damaged beyond what was declared
  • Item is torn, destroyed, or missing entirely
  • Item is completely different from what was listed (wrong item sent)
  • Item is non-functional when it was listed as functional

7.3 Non-Disputable Conditions. The following are not considered valid dispute grounds and will be rejected:

  • Minor scratches, scuffs, or surface marks that are consistent with normal wear
  • Slight colour variation due to photography lighting or screen differences
  • Minor size or fit differences within reasonable tolerance
  • Cosmetic imperfections that were present and visible in the listing photos
  • Defects that were explicitly declared in the listing's Known Defects section
  • Change of mind after confirmation of receipt

7.4 Warehouse Record as Baseline. ReSwaps warehouse photographs items upon receipt. The condition recorded at the warehouse is the official baseline. If an item arrives at the recipient in a condition materially different from the warehouse record, this constitutes a valid transit damage claim — which will be filed with the courier on your behalf.

7.5 Decision. ReSwaps staff will review all disputes and issue a final, binding decision. The decision of ReSwaps is final. Possible outcomes include: dismissal (no action), partial credit compensation, or full swap reversal.

8. Prohibited Items

The following may not be listed or swapped on ReSwaps:

  • Weapons, firearms, or explosive materials
  • Illegal drugs or controlled substances
  • Counterfeit, stolen, or infringing goods
  • Live animals or perishables
  • Hazardous or flammable materials
  • Liquids in any form
  • Adult or prohibited content
  • Any item prohibited under Malaysian law

Violating this section results in immediate account suspension and reporting to relevant authorities.

9. User Conduct

You agree not to:

  • Misrepresent item condition, value, or description
  • Fail to disclose known defects at the time of listing
  • Harass, threaten, or abuse other users
  • Attempt to conduct transactions outside the Platform to avoid fees
  • Create multiple accounts or impersonate others
  • Raise false or frivolous disputes
  • Attempt to circumvent the Platform's security or verification systems

10. Account Suspension & Termination

ReSwaps reserves the right to suspend or permanently terminate any account at our sole discretion, including but not limited to: fraudulent activity, repeated frivolous disputes, listing prohibited items, or any behaviour deemed harmful to the community. No refund of credits will be issued upon termination for cause.

11. Limitation of Liability

ReSwaps is a peer-to-peer marketplace and warehouse facilitator. We are not a party to the item exchange between users. To the maximum extent permitted by Malaysian law, ReSwaps shall not be liable for any indirect, incidental, or consequential damages arising from use of the Platform, including subjective dissatisfaction with item condition, loss of data, or financial loss beyond the credit balance held on your behalf.

12. Governing Law

These Terms are governed by the laws of Malaysia. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
